§ 1. Introduction and Subject Matter
- These regulations ("Terms") set out the rules for using the website available at snap4.id (hereinafter referred to as the "Service").
- The Service is operated under the brand Snap4ID by OWN-WAY NET, located at 150 Essex Ave, Glen Ridge, NJ 07028, USA ("Service Provider").
- A User of the Service ("User") is any person visiting or using the Service via a web browser.
- The subject of the Service is to provide an online tool allowing the User to take photos for official documents, process them using the Service Provider's technology, and download the processed result in digital form ("Product").
- Snap4ID is photo-editing software. We resize, crop and adjust the background of a photo you provide so it meets the published size and format requirements for passport, visa and ID applications. We do not verify identity, issue or sell documents, perform facial recognition, or build biometric profiles.
§ 2. General Rules of Use
- The Service is intended for adults (18 years of age or older) who have full legal capacity.
- To use the Service, it is necessary to have a device with Internet access and a properly configured web browser (e.g., Chrome, Safari, Firefox).
- The User is obliged to use the Service in a manner consistent with the law and good morals, specifically by not uploading content that is illegal, offensive, or infringes on the rights of third parties (e.g., uploading someone else's image without consent).
§ 3. Provision of Services, Guarantee and Liability Waiver
- The Service consists of automatic verification, cropping, and quality enhancement of the uploaded facial photo to adapt it to the requirements of the selected document (e.g., passport).
- The Service Provider makes every effort to ensure that the technology works correctly and that photo requirements and document specifications are accurate, up-to-date, and consistent with official guidelines. The acceptance guarantee is limited; however, in the event of rejection of the photo by an authority, the User is entitled to a full money-back guarantee under our Refund Policy (see § 5).
- Services are provided electronically. The server infrastructure may be located outside the European Economic Area (e.g., in the US), as detailed in the Privacy Policy.
- Waiver and Limitation of Liability: To the maximum extent permitted by applicable law, the Service Provider's liability for any damages arising from Product inaccuracy, rejection by authorities, verification issues, or technology malfunction is limited solely to the amount paid by the User for the Product. The refund constitutes the sole and exclusive remedy, and the User waives the right to file lawsuits or assert claims for damages exceeding the price of the Product.
§ 4. Payments and Merchant of Record
- The payment and sales process regarding the Product is handled in a Merchant of Record model by our external partner based in the United Kingdom, Paddle.
- By making a purchase, the User enters into a transaction with the Merchant of Record (Paddle), who is responsible for payment processing, issuing proof of purchase/invoices, and handling local tax matters (e.g., VAT, Sales Tax) applicable to the User's jurisdiction.
- The Service Provider (OWN-WAY NET) delivers the digital content (Product) only after receiving confirmation from the partner (Paddle) that the order has been successfully paid.
- Prices in the Service are gross amounts and include applicable taxes, unless otherwise indicated at checkout.
§ 5. Complaints, Refunds and Right of Withdrawal
- Refunds — including the money-back guarantee for a photo rejected by an authority — are governed by our Refund Policy, which forms part of these Terms. Complaints regarding the operation of the Service or the quality of the Product may be reported to the Service Provider at service@snap4.id and will be addressed within 14 days.
- Exception to the Right of Withdrawal: To the extent permitted by applicable consumer-protection law (including, for consumers in the EU/EEA, Art. 16(m) of Directive 2011/83/EU), the right of withdrawal (the "cooling-off period") is not applicable to contracts for the supply of digital content that is not supplied on a tangible medium, provided the performance has begun with the consumer's prior express consent.
- User Consent: By clicking the purchase/download button, the User expressly consents to the immediate commencement of the service performance (delivery of digital content) and acknowledges that they thereby lose their right of withdrawal from the contract.
§ 6. Personal Data
The scope of collection, use, and disclosure of personal data, along with the User's rights (GDPR), is described in our Privacy Policy.
§ 7. Final Provisions and Governing Law
- The governing law for contractual obligations arising from these Terms is the law of the State of New Jersey, USA, without regard to its conflict-of-law provisions.
- This provision does not deprive a User who is a consumer of the protection afforded to them by mandatory provisions of the law of their country of habitual residence (e.g., mandatory consumer rights in the EU/EEA, UK, or the USA), which cannot be derogated from by agreement.
- In matters not regulated by these Terms, the relevant provisions of applicable law shall apply.
- The Service Provider reserves the right to amend these Terms. Changes enter into force within 7 days of their publication in the Service.
